These terms of sale apply to the Supporter subscription of OpenAthlete Cloud (app.openathlete.org), taken out by a consumer or business customer. Using OpenAthlete for free involves no sale and is not covered by these terms. If the versions differ, the French version prevails.
The subscription is sold by Tristan BOUILLOT--AUBIN, sole trader (micro-entreprise), 4 rue Augustin Blanc, 38000 Grenoble, France, SIREN 833 763 154, EU VAT number FR41833763154. Contact: tristan@openathlete.org.
Every feature of OpenAthlete Cloud is free. The Supporter subscription funds the development of the open-source project and adds:
AI features are an aid: they replace neither a coach nor medical advice. The service evolves; its essential features above are not reduced during a period already paid for.
The subscription costs €5 per month or €50 per year, all taxes included (French VAT at 20% included). The applicable price is the one shown when ordering. Any price change is announced by email at least 30 days before the renewal it applies to; the customer may cancel before then.
The customer subscribes from Settings > Subscription in the app, choosing monthly or yearly billing, then accepting these terms. Payment is handled by Stripe, which processes payment data: OpenAthlete stores no card numbers. The price is paid when subscribing, then at each renewal. Invoices are available in the app. If a payment fails, Supporter benefits are suspended until it is settled; free use continues.
The subscription has no minimum term. It renews automatically at the end of each period (month or year) until cancelled. The customer may cancel at any time from Settings > Subscription; cancellation takes effect at the end of the current, already paid period, at no further cost. Switching between monthly and yearly billing is charged pro rata. For a yearly subscription, the customer is informed by email before renewal.
Consumer customers have 14 days from subscribing to withdraw, without giving a reason (article L221-18 of the French Consumer Code). By ticking the box shown before payment, they expressly ask for the subscription to start immediately, during that period. If they withdraw, they are refunded within 14 days, through the same payment method, minus an amount proportional to the time elapsed until their request (article L221-25).
To withdraw, the customer sends a clear statement to tristan@openathlete.org, for example with the form below:
"To Tristan BOUILLOT--AUBIN, 4 rue Augustin Blanc, 38000 Grenoble, France, tristan@openathlete.org: I hereby give notice that I withdraw from my contract for the OpenAthlete Supporter subscription, taken out on [date], in the name of [name], with the account email [email]. Date: [date]."
Consumer customers benefit from the legal guarantee of conformity for digital services (articles L224-25-1 et seq. of the French Consumer Code). The seller takes reasonable steps to keep the service available, but cannot guarantee it will never be interrupted, in particular for maintenance. To the extent permitted by law, the seller's liability towards a business customer is limited to the amounts paid in the last 12 months.
The customer's data is processed as described in the privacy policy. The customer can download it and delete their account at any time from the app; deleting the account cancels the subscription. Privacy Policy
Complaints can be sent to tristan@openathlete.org; we answer within 15 days. Under articles L611-1 et seq. of the French Consumer Code, consumer customers may then use a consumer mediator free of charge. The seller is joining a mediator; its details will be given here.
These terms are governed by French law. Consumer customers may bring a claim before the courts of their place of residence or of the place where the contract is performed, and keep the protection of the mandatory provisions of their country of residence. The applicable terms are those accepted when subscribing; a new version applies from the next renewal after being notified by email at least 30 days before.
